In Virginia, resisting arrest specifically involves preventing or attempting to prevent your own lawful arrest through force, threats, or other means. Obstruction of justice is broader and includes interfering with any law enforcement investigation, court proceeding, or legal process. This can include interfering with someone else’s arrest, tampering with evidence, intimidating witnesses, or providing false information to police. Both are serious charges that can be misdemeanors or felonies depending on the circumstances.

Resisting arrest in Virginia is typically a Class 1 misdemeanor punishable by up to 12 months in jail and a $2,500 fine. However, if the resistance involves threats or force against the officer, or if weapons are involved, it can be elevated to a felony with much harsher penalties. The specific penalty depends on the degree of resistance, whether anyone was injured, the defendant’s criminal history, and other aggravating or mitigating factors.

Virginia law generally does not allow you to resist even an unlawful arrest. The proper remedy for an unlawful arrest is to challenge it in court later, not to resist at the scene. However, there are limited exceptions, such as when police use excessive force that threatens serious injury or death. The key issue is often whether the arrest was actually lawful – many people incorrectly believe an arrest is unlawful when it’s actually valid under the law.

Simply asking questions or trying to explain yourself is not resisting arrest. However, if your actions physically prevent or delay the arrest process, police may charge you with resistance. The key is whether your conduct actually interfered with the officer’s ability to make the arrest. Verbal protests alone typically don’t constitute resistance, but physical pulling away, tensing up, or failing to comply with commands can be charged as resistance even if you didn’t intend to resist.

Common defenses to Virginia resisting arrest charges include unlawful arrest, excessive police force, self-defense, medical conditions that prevented compliance, mental health issues, disability that affected your ability to comply, police misconduct, lack of intent to resist, involuntary reflexive actions, and constitutional violations. Each case requires careful analysis of the arrest circumstances, police body camera footage, witness testimony, and medical evidence to build the strongest defense.

Body camera footage can be crucial evidence in resisting arrest cases, either helping or hurting your defense depending on what it shows. The footage may reveal that you didn’t actually resist, that police used excessive force, that you were complying with conflicting commands, or that you had a medical emergency. However, it may also show resistance that supports the charges. An experienced attorney will carefully analyze all available video evidence to determine how it impacts your case.

Yes, mental illness, developmental disabilities, physical disabilities, or medical conditions can significantly impact resisting arrest cases. These conditions may explain why someone couldn’t understand or comply with police commands, or why their body responded in ways that appeared to be resistance. Virginia law recognizes these factors, and they can be used as defenses or mitigation. Expert testimony from medical professionals may be necessary to explain how the condition affected your ability to comply with police.
