Read until the end to learn more.

Avoid These Bus Accident Claim Mistakes

When you are going up against an insurance company that represents a bus, you can expect that there will be challenges. Before you get started with your case, please heed our warnings. These are mistakes you never want to make.

Delaying Being Seen by a Doctor

You should never delay being seen by a doctor. You are likely going to have very serious injuries that could be masked by the adrenaline you feel after your accident.

It is important to recognize that the absence of pain following an accident does not mean you are not hurt.

See a doctor as soon as you possibly can.

If you do not see a doctor immediately, your injuries could worsen. That means your recovery period will be longer.

Not only that, if you do not get to a doctor right away, the insurance company may become suspicious. They could go as far as saying that you lied about your injuries. Not seeing a doctor right away could give them a reason to try to throw away your claim.

Do not give them this opportunity.

Ignoring What Your Doctor Tells You

If you ignore advice from your doctor, not only are you risking your injuries getting worse, you are risking ruining your claim.

If the insurance company has an investigator watching you, they will be looking to see you doing something you are not supposed to be doing.

For instance, if you were told not to lift anything heavier than five pounds after surgery, and the investigator saw you at the grocery store carrying a 15-pound tub of cat litter, they could snap a photo of this and use it as evidence against you.

With evidence like that, they can claim that you are not suffering the way you say you are. Even if you only held that litter for a second, that photo is forever.

Be cautious. Listen to your doctor. Do not give the insurance company any power over you.

Agreeing to Provide a Recorded Statement

You may have seen a lot of commercials and advertisements for insurance companies that have led you to believe that they are there to help you in your time of need.

They do a great job as marketing themselves as helpful.

The truth is that the insurance companies want to make a profit. They are a company like any other.

By denying people of compensation awards or reducing the value of the claim, they can save money.

We want you to think about that when you receive a phone call from the insurance company that represents the bus.

If they are calling to record a statement from you, the best thing that you can do is hang up the phone.

There is nothing in it for you if you speak with them.

They are hoping that you will fall for the façade that they are going to get your case resolved in your favor. They have been trained specifically to get you to say something that would ruin the claim for you while helping their company reduce the value of your case.

You have no legal obligation to answer the phone when they call. You do not have to speak to them. Let your lawyers handle this communication so you never have to worry about saying the wrong thing.

        Delaying Hiring a Lawyer

If you were to wait to hire a lawyer, you are putting the success of your case in jeopardy.

A few things will happen if you don’t get started on your case right away:

First, your evidence can quickly disappear. Anything that you have not already collected can go missing. Video footage could be deleted after a few days. The witnesses to your accident could become untraceable or they could forget important details about your accident.

None of this is going to be good for your case.

Second, if you do not call an attorney right away, the task could easily slip to the bottom of your priorities.

You don’t have an unlimited amount of time to file your claim. Virginia only gives you two years from the date of your accident to file your claim.

        Hire a lawyer immediately.

        Picking the Wrong Lawyer

You get one opportunity to bring your claim against the liable party. There is no going back to ask for a different result once the case is resolved.

When you are considering who to hire as a lawyer for your case, you need to choose very carefully. The person who represents you is going to make or break the results of your claim.

You should always pick the best person for the job.

You would never hire an interior designer to do the plumbing in your house, right? Both of those professions work with homes, but they handle completely different things.

        The same goes for attorneys.

You shouldn’t hire a divorce lawyer for a bus accident case.

The divorce lawyer might be excellent at handing all things related to family law, but it does not mean they will be great at handling personal injury cases.

You want to make sure that the lawyer representing your case is someone who handles bus accident claims on a regular basis. You don’t want someone who does not have specialized experience with personal injury cases.

Select the person you are going to be working with towards justice carefully. You should be able to trust them completely to handle this case with ease. They should be able to show you a laundry list of cases like yours that they have successfully handled in the past.

Also, if you go with a trial lawyer, you are more likely to get the insurance company to cooperate because they don’t want this case to end up in front of a jury.

        Virginia Bus Accident Client Story

Disclaimer: We have changed our client’s names and some details to protect their identity.

On a rainy Tuesday morning, Dorothea was leaving her house to catch the bus to work. She was a director at a daycare center. She absolutely loved her work.

Her own children were grown at this point. They had each moved out into their own places in new cities.

Now it was just her and her husband, Jerry, who was not able to work. He had severe arthritis that kept him from being able to work.

They had disposable income, but things were alright for them.

On the bus, Dorothea liked to read. She would get lost in her books so much so that she nearly missed her stop a few times.

Thankfully, the bus drivers knew her.

They would say, “Miss Dorothea, it’s time to go.”

Today she was reading a book her grandson picked out for her at random the last time she was out to visit him in California.

Out of seemingly nowhere, Dorothea was thrown from her seat. She hit the ground in front of her hard.

After she realized the bus was just in a crash, she assessed herself. Her head certainly felt strange. Her arm was also in a great deal of pain.

The driver of the bus rushed to her to help her up. Together they waited for the police to arrive. She made an accident report while EMS checked out her injuries.

They asked her if she wanted a ride in the ambulance because it seemed she had a concussion, and her arm was in need of an x-ray. It had become quite swollen as time passed.

She accepted the ride and was taken to the nearest emergency room.

They let her know that she had a concussion as well as a fracture in her arm.

She was horrified to hear this.

Jerry relied on her for so much at home. The babies at the daycare needed to be picked up. She wasn’t going to be able to cook.

It was a rough few days of learning how to cope with these injuries.

She experienced a lot of strange symptoms from her concussion that made her daily activities harder.

Finally, she decided to look online to find a lawyer who might be able to hold the driver of the car that hit the bus responsible for all the pain she was experiencing.

Her searching led her to set up a free consultation with us.

During this first meeting, she had three main questions for us.

        1. When would this case be over?
        2. What are the fees for a lawyer?
        3. How much money would the case be worth?

You likely have the same questions if you have been hurt on a bus.

Here is what we told her:

When would this case be over?

Dorothea was in desperate need for some relieve. Not only was it killing her to be away from the kids she loved at her daycare, it was becoming too difficult to care for her husband alone. She was looking into getting at home care for him.

Money was getting too tight for comfort.

She wanted to know when she could expect the compensation award to be given to her.

This is something almost everyone asks about during their first consultation with us.

We tell our clients, as we told Dorothea; we need to know when you make a full recovery.

Once we know you have reached maximum medical improvement and there will be no more medical expenses related to your accident, then we will be closer to determining how long your case should take to resolve.

If we recovered an award before you fully recover, it would likely not be as full as it possible could be and any additional medical expenses would not be included in your compensation

Also, the timeline in which a case resolves depends on how much the insurance company drags their feet to provide you with a fair result.

They are far more likely to give a quicker result when they are met with having to go up against a trial lawyer.

What are the fees for a lawyer?

Because money was already so tight for Dorothea and Jerry, you could see worry in her eyes when she asked how much we charge for our representation.

We assured her that, to have us take on her case, it would be no cost to her upfront.

We work on a contingency fee basis which means we do not earn a penny unless we win your case.

When we win a claim, a small portion of the compensation award goes towards the costs of investigating case as well as any attorney fees.

Dorothea seemed elated to know this. It was going to ease so much of her anxiety not to have to worry about coming up with the money to get representation for her claim.

How much money would the case be worth?

Dorothea had heard the commercials they play on the radio about how lawyers win billions of dollars for their clients.

She told us, “It sure sounds nice to think about billions of dollars and while I don’t think I’ll end up with that kind of money, it would be nice to get these medical bills paid for.” She chuckled at this.

She had a good sense of humor for someone who was in such a tough place.

We told her that we were going to fight for every penny’s worth of damages that she had suffered. That included all of the medical bills that were weighing heavy on her mind.

Not only that, any money she missed out on making from work when she had to take time off was also going to be included in the compensation award.

When we think about how much a case is worth, we look at all aspects of life that have been affected.

Because of this bus accident, Dorothea was missing out on so many things she loved to do. Holding her books one handed was nearly impossible, so she couldn’t read like she used to. She couldn’t care for Jerry like she wanted to. Her hobbies were limited to things she could do without both hands which got rid of just about everything she liked to do.

We assured her that we would fight to the bitter end to get her the results that fully reflected everything she had suffered through because of this bus accident.

She left that first meeting with us feeling confident about her case.

We grew to know her as a true helper. She wanted to become whole again so she could once again give her whole self to others.

We were proud to be by her side throughout her journey to justice.

“I had a minor but bothersome issue on a litigation, and Nova Legal Group were extremely efficient, very effective and I am 100% pleased with the results they drove, and I am also quite impressed they managed to do my work and obtain the favorable resolution ahead of schedule during the year of COVID. And I think their fee structure is easy to work with and very reasonable.”
