    Other Charges

You can be charged with drug crimes if you have illegal drugs on your person, you manufacture them, you distribute them, or you use a substance that is considered to be illegal according to Virginia law. If you abuse or possess a controlled substance including prescription drugs you can be charged with a drug crime. It is up to the prosecutors to determine if this is going to be a possession charge. If they simply found some drugs in your living space, that does not necessarily mean that they have enough evidence to convict you for possession. We can help you learn more about this.

    Prescription Drug Abuse

If you were to be in possession of a prescription drug, you could face criminal charges especially if it’s not your prescription and you are not supposed to be in possession of it. Furthermore, if you were found to be impaired because of prescription drug use while you were operating a car or motor vehicle, you will not only face a drug charge you will also be facing a DUI which is driving under the influence. It doesn’t matter if this prescription drug was meant for you or not if you are driving the car while impaired by it.

    Virginia Drug Crime Law

Virginia state law treats drug crimes harshly and the penalties that you might be facing can be life altering, while the stigma that you would face if you are convicted can hinder your life. Our Virginia drug crime lawyers will fight to defend you against these charges to protect your future and your livelihood. If they can find out that something along the course of you being charged with this drug crime was an issue then we can pursue an investigation for example police misconduct. If there was an issue with the search of evidence or your arrest for example we can fight it. This can help us avoid harsh penalties.

In Virginia, the most commonly seen charge is possession. Most often the drugs involved in a possession charge are cocaine or meth amphetamines. Prescription drugs often seen in drug charges are Xanax and Adderall. Lately, charges for heroin have been rising. If you were up against a charge like this, please call our Virginia drug crime lawyers today.

    Penalties You May Be Facing

Our Virginia drug crime lawyers are here to help you understand what penalties you were up against that are associated with the charge you’re facing. Often times the penalties can be severe and life altering. They can increase if you were in a particular spot such as a school or in the presence of a child. They also depend on how much of what substance you have.

If you ended up getting charged with possession of a Schedule 1 or 2 controlled substance you will be facing a Class 5 felony, which carries the penalties of up to $25,000 as well as up to 10 years of prison.

For a charge of possession of a controlled substance Schedule 3 drug you could be facing penalties of up to $2500 as well as being incarcerated for up to one year. You would be able to have this charge be a misdemeanor instead of a felony. Other types of misdemeanors include possession of a Schedule 5 drug which is a Class 3 misdemeanor that carries a fine of up to $500. Furthermore if you are charged with a Schedule 6 controlled substance your fine for this class for misdemeanor can be up to $250.

If you had been charged with manufacturing or selling and distributing a controlled substance as per the Virginia criminal code, it means you had such a large quantity of a drug that they believed us to be enough evidence to prove that you were going to sell or distribute these drugs which can increase your charges.

For further information about what to expect for your drug charge, please get in touch with our Virginia drug crime lawyers as soon as you possibly can. We will go over your case and let you know what you have rights for. Then we will fight to see how we can reduce the penalties that you’re facing or potentially be able to get your charges dropped.

    Constitutional Issues

We take into consideration the constitutional issues that might present themselves during every step of your drug case. Often there can be a violation of your constitutional right if you’ve been stopped by a police officer or searched by one. If you were pulled over by a police officer while you were in your car, and they did not have a legal reason to pull you over and they found drugs when they searched your car you might be able to get away with these charges and not face the penalties.

    Drug Schedules

There was the drug control act in Virginia that helped federally classify what drugs were considered what schedule of drug. They are ranked from the heaviest charged and penalized substance to the least.

Here’s what you need to know about drug schedules.

Schedule 1 – Addictive drugs that have no known medical properties such as heroin, LSD, and Ecstasy.

Schedule 2 — Addictive drugs that have some medical properties including cocaine, PCP and morphine.

Schedule 3 — Highly addictive drugs that are often used medically such as steroids, ketamine and hydrocodone.

Schedule 4 — Slightly addictive drugs that are frequently medically used such as Valium and Xanax.

Schedule 5 – Medications with minor risks such as codeine

The Virginia code includes the drug control act of Virginia which gave us these drug schedules. If you have any further questions we hope that you get in contact with us as soon as possible.

“I had a minor but bothersome issue on a litigation, and Nova Legal Group were extremely efficient, very effective and I am 100% pleased with the results they drove, and I am also quite impressed they managed to do my work and obtain the favorable resolution ahead of schedule during the year of COVID. And I think their fee structure is easy to work with and very reasonable.”
